上海市總工會發出《提示函》!事關勞動報酬、支付規范、最低工資!

工(gong)會勞動法(fa)律監督提示函

全市各用人單(dan)位(wei):

勞(lao)動(dong)(dong)(dong)報(bao)酬是勞(lao)動(dong)(dong)(dong)者最(zui)直(zhi)接、最(zui)核心的權益(yi)。黨中央(yang)、國(guo)務(wu)院高度重(zhong)視治理欠(qian)薪(xin)工作。為落實好治理欠(qian)薪(xin)冬季(ji)行(xing)動(dong)(dong)(dong)的部署,保障廣大勞(lao)動(dong)(dong)(dong)者按時足額取得(de)勞(lao)動(dong)(dong)(dong)報(bao)酬,根據(ju)《中華(hua)人民(min)(min)共和(he)國(guo)工會法(fa)》《中華(hua)人民(min)(min)共和(he)國(guo)勞(lao)動(dong)(dong)(dong)法(fa)》《中華(hua)人民(min)(min)共和(he)國(guo)勞(lao)動(dong)(dong)(dong)合同法(fa)》《保障農民(min)(min)工工資(zi)支付條例(li)(li)》《上(shang)海(hai)(hai)市(shi)工會條例(li)(li)》等法(fa)律法(fa)規,以及(ji)《新就業(ye)形態勞(lao)動(dong)(dong)(dong)者休息和(he)勞(lao)動(dong)(dong)(dong)報(bao)酬權益(yi)保障指引》《上(shang)海(hai)(hai)市(shi)企業(ye)工資(zi)支付辦(ban)法(fa)》《上(shang)海(hai)(hai)工會勞(lao)動(dong)(dong)(dong)法(fa)律監督辦(ban)法(fa)》等文件要求,現就以下事項提(ti)醒各用人單位:

一、自覺履行勞動報酬支付義務

通過銀行(xing)轉賬或(huo)(huo)者(zhe)以現金的(de)形(xing)式將勞(lao)(lao)動(dong)報酬按時足額(e)支付給勞(lao)(lao)動(dong)者(zhe)本人,不(bu)得(de)克扣或(huo)(huo)無故拖欠。如遇法(fa)定節假日(ri)或(huo)(huo)休息(xi)日(ri),應當(dang)在法(fa)定節假日(ri)或(huo)(huo)者(zhe)休息(xi)日(ri)前支付,不(bu)能順延。依(yi)法(fa)保障勞(lao)(lao)務(wu)派遣、外包等合作用工方(fang)式勞(lao)(lao)動(dong)者(zhe)相關(guan)權益(yi)。

二、明確勞動報酬相關勞動規則

與勞(lao)(lao)動(dong)者(zhe)(zhe)依法(fa)訂(ding)立(li)勞(lao)(lao)動(dong)合同(tong),明確勞(lao)(lao)動(dong)報(bao)(bao)酬支(zhi)付(fu)(fu)標準(zhun)、支(zhi)付(fu)(fu)時間、支(zhi)付(fu)(fu)方式等內容(rong)。新就(jiu)業形(xing)(xing)態領域不完(wan)全符合確立(li)勞(lao)(lao)動(dong)關(guan)系情形(xing)(xing)的(de),由(you)平臺企業與勞(lao)(lao)動(dong)者(zhe)(zhe)訂(ding)立(li)書面協議,明確勞(lao)(lao)動(dong)定額(e)標準(zhun)、抽成(cheng)比例(li)、計件(jian)單(dan)價、勞(lao)(lao)動(dong)報(bao)(bao)酬支(zhi)付(fu)(fu)周期、考核辦法(fa)等勞(lao)(lao)動(dong)報(bao)(bao)酬規則。

三、落實最低工資保障制度

向提(ti)供正常(chang)勞(lao)(lao)(lao)動(dong)的勞(lao)(lao)(lao)動(dong)者支(zhi)付(fu)不(bu)低于當地(di)最(zui)低工資標準的勞(lao)(lao)(lao)動(dong)報酬。不(bu)完全(quan)符合確立勞(lao)(lao)(lao)動(dong)關系情形但平臺企業對勞(lao)(lao)(lao)動(dong)者進行(xing)勞(lao)(lao)(lao)動(dong)管理的新就業形態勞(lao)(lao)(lao)動(dong)者,適用勞(lao)(lao)(lao)動(dong)者實際工作(zuo)地(di)人民(min)政府(fu)規(gui)定的小時最(zui)低工資標準。

四、依法建立和完善勞動規章制度

用人單位(wei)在制定、修改(gai)或(huo)者決定有(you)關勞(lao)動(dong)(dong)報酬等涉及勞(lao)動(dong)(dong)者切(qie)身利益(yi)的規章制度或(huo)者重(zhong)大事(shi)項時,應(ying)當經(jing)職工代表大會(hui)或(huo)者全體(ti)職工討論,提出方案和意見,與工會(hui)或(huo)者職工代表平等協商(shang)(shang)確定。依(yi)法開展工資集體(ti)協商(shang)(shang)。

五、依法落實工程建設領域特別規定

施工(gong)(gong)(gong)總(zong)承(cheng)包單位(wei)應當按(an)照有關規定開設(she)農(nong)民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)專用賬戶(hu)(hu),實(shi)行勞動(dong)用工(gong)(gong)(gong)實(shi)名制(zhi)管(guan)理。工(gong)(gong)(gong)程建設(she)單位(wei)應當按(an)規定及時足(zu)額向(xiang)農(nong)民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)專用賬戶(hu)(hu)撥付工(gong)(gong)(gong)程款中(zhong)的人工(gong)(gong)(gong)費用,撥付周期不超(chao)過1個(ge)月。施工(gong)(gong)(gong)合同要求履約(yue)擔保的,工(gong)(gong)(gong)程建設(she)單位(wei)應提供工(gong)(gong)(gong)程款支付擔保。

六、及時發現、主動整改欠薪隱患

對(dui)勞(lao)動報酬支付情況開展自(zi)查自(zi)糾;主動接受、配合勞(lao)動保障(zhang)(zhang)監(jian)察部門、相關行業工(gong)程(cheng)建設主管(guan)部門、工(gong)會和(he)其他有關部門對(dui)保障(zhang)(zhang)勞(lao)動者勞(lao)動報酬工(gong)作的監(jian)管(guan)和(he)監(jian)督。
